Welcome to BYESKOOL . These Terms of Use (“Terms”) govern your access to and use of the BYESKOOL website, software, platform, tools, and services (collectively, the “Platform”).

By creating an account, purchasing a subscription, or using BYESKOOL, you agree to these Terms. If you do not agree with these Terms, please do not use the Platform.

1. About BYESKOOL

BYESKOOL is a SaaS platform designed to help educators, coaches, trainers, course creators, businesses, freelancers, and agencies create and manage websites and digital experiences using various tools and features provided through the Platform.

BYESKOOL is currently operated under the BYESKOOL brand. Any future change in the legal entity operating the Platform will not affect the validity of these Terms unless otherwise communicated to users.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use BYESKOOL.

If you are using BYESKOOL on behalf of a business, agency, or organization, you confirm that you have authority to accept these Terms on its behalf.

3. Account Registration

To use certain features of BYESKOOL, you must create an account and provide accurate information.

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• Keeping your account information accurate and updated.
• All activities performed through your account.
• Immediately notifying BYESKOOL if you believe your account has been accessed without authorization.

You must not share your primary account login credentials with other people.

Where staff accounts are available, you should use the staff-user functionality provided by BYESKOOL rather than sharing your main account.

4. Subscription Plans and Pricing

BYESKOOL may offer different subscription plans and pricing. Current subscription plans include:

BYESKOOL may change its pricing, plans, features, or limits in the future. Any changes applicable to an existing subscription will be communicated where required.

Detailed refund and cancellation terms are provided separately in the Refund & Cancellation Policy .

5. Staff Users

Depending on your subscription plan:

• Quarterly plans allow up to 5 staff users .
• Yearly plans allow up to 7 staff users .

You are responsible for the actions of users you add to your account.

BYESKOOL may modify staff-user limits for future plans or subscriptions.

6. Websites and Hosting

BYESKOOL may allow you to create and manage websites through the Platform.

Under the current Quarterly and Yearly plans, users may create unlimited websites , subject to reasonable use and any technical limitations of the Platform.

Websites created using BYESKOOL are hosted using BYESKOOL's hosting infrastructure.

You may connect a custom domain that you own or control to your website.

BYESKOOL does not claim ownership of your independently registered custom domain. Domain registration and renewal are your responsibility unless otherwise agreed in writing.

7. Subscription Expiry

Your access to BYESKOOL and websites hosted through the Platform depends on an active subscription. If your subscription expires:

• Your hosted website may become unavailable immediately.
• Your account and associated data may remain retained for up to 30 days after expiry.
• If you renew within this period, BYESKOOL may restore your account and website where technically possible.
• After the 30-day period, BYESKOOL may permanently delete the account, website, and associated data.

You are responsible for maintaining your own backups of important content and data.

8. Renewal and Automatic Renewal

The first renewal of a subscription is completed manually.

After the first renewal, subsequent renewals may be processed automatically where automatic renewal has been enabled.

You may cancel automatic renewal before your next renewal date.

Cancelling automatic renewal does not immediately terminate an already-paid subscription. You will generally retain access until the end of the period for which you have already paid.

If an automatic renewal payment fails, BYESKOOL may provide a 7-day period to complete the payment. If payment is not received within that period, access to the Platform may be suspended.

9. AI Features and Third-Party AI Services

Certain BYESKOOL features may use or connect with third-party artificial intelligence services, including services such as OpenAI and Google Gemini .

Where BYESKOOL allows you to connect or use your own third-party AI account, API key, subscription, or credits:

• You are responsible for maintaining your own third-party AI account.
• You are responsible for purchasing or recharging AI credits directly from the relevant AI provider.
• AI usage charges are separate from BYESKOOL subscription fees.
• BYESKOOL does not guarantee the pricing, availability, performance, or policies of third-party AI providers.
• Your use of third-party AI services is also subject to the relevant provider's terms and policies.

BYESKOOL is primarily providing the interface, platform, and tools through which supported AI services may be used.

10. Templates and Website Assets

BYESKOOL may provide templates, designs, layouts, components, graphics, or other website-building resources.

You may use BYESKOOL templates to create websites for yourself, your business, or your clients, including for commercial purposes, subject to these Terms.

However, you may not:

• Resell BYESKOOL templates as standalone products.
• Redistribute or share the templates as a template library.
• Make the templates available for unauthorized download or distribution.
• Use BYESKOOL templates to create a competing template marketplace or library.

The underlying templates, software, designs, and platform technology remain the property of BYESKOOL or its respective licensors.

11. Customer Content

You retain ownership of the content that you upload or create through BYESKOOL, including your text, images, videos, branding, course information, and other materials, except for content or assets owned by BYESKOOL or third parties.

You grant BYESKOOL a limited, non-exclusive right to host, store, process, display, transmit, and otherwise use your content only as reasonably necessary to provide, maintain, secure, and improve the Platform.

You are responsible for ensuring that you have the necessary rights and permissions to use the content you upload.

12. BYESKOOL Intellectual Property

The BYESKOOL name, branding, software, platform, technology, user interface, features, templates, designs, documentation, and other original materials provided by BYESKOOL are owned by or licensed to BYESKOOL.

Your subscription gives you a limited, non-exclusive, non-transferable right to use the Platform during your active subscription.

Your subscription does not transfer ownership of BYESKOOL's software, technology, templates, or intellectual property to you.

13. BYESKOOL Branding

On standard Quarterly and Yearly plans, BYESKOOL branding such as “Powered by BYESKOOL” may remain visible on websites or services created using the Platform.

Customers using an approved White Label plan may be permitted to use their own branding and remove BYESKOOL branding, according to the specific White Label agreement and features purchased.

White Label terms, features, pricing, and limitations may vary depending on the customer's requirements.

14. Use for Clients

You may use BYESKOOL to create websites or digital experiences for your own clients, provided that your use complies with these Terms.

However, you may not resell, sublicense, copy, or provide the BYESKOOL Platform itself as your own competing SaaS platform unless you have purchased an applicable White Label or other authorized arrangement from BYESKOOL.

15. Acceptable Use

You agree not to use BYESKOOL to:

• Conduct illegal activities.
• Violate any applicable law or regulation.
• Infringe another person's intellectual property or privacy rights.
• Distribute malware, viruses, or harmful code.
• Conduct fraud, scams, phishing, or deceptive activities.
• Upload content that is unlawful or that you do not have permission to use.
• Abuse, disrupt, or attempt to damage the Platform or its infrastructure.
• Attempt to gain unauthorized access to another account or system.
• Reverse engineer, copy, modify, or reproduce BYESKOOL's software or platform.
• Use BYESKOOL to create a competing platform without authorization.

BYESKOOL reserves the right to investigate suspected violations and take appropriate action.

16. Customer Responsibility

You are responsible for:

• The websites you create.
• Your website content.
• Your customers and website visitors.
• Any products or services you sell through your website.
• Compliance with applicable laws.
• Your privacy policy, terms, cookie notices, and other legal requirements where applicable.
• Any third-party services you connect to BYESKOOL.

BYESKOOL provides the technology platform but does not become responsible for your individual business activities or customer relationships.

17. Third-Party Services

BYESKOOL may integrate with or provide access to third-party services such as AI providers, payment providers, domain providers, communication services, analytics tools, and other external services.

Third-party services are controlled by their respective providers.

BYESKOOL is not responsible for third-party services, including their availability, pricing, policies, security, performance, or changes.

Your use of such services may be subject to additional terms imposed by those providers.

18. Customer Support

BYESKOOL currently provides customer support primarily through WhatsApp .

Support availability and response times may vary depending on the nature and complexity of the request.

BYESKOOL does not guarantee a specific response time unless expressly agreed otherwise.

19. Service Availability

BYESKOOL aims to keep the Platform reliable and available, but does not guarantee uninterrupted, error-free, or continuous availability .

The Platform may occasionally be unavailable because of:

• Maintenance.
• Updates.
• Technical problems.
• Security incidents.
• Infrastructure issues.
• Third-party service failures.
• Internet or network problems.
• Events outside BYESKOOL's reasonable control.

No specific uptime percentage or Service Level Agreement (SLA) is provided unless separately agreed in writing.

20. Suspension or Termination

BYESKOOL may suspend or terminate an account if:

• You violate these Terms.
• You engage in illegal or harmful activities.
• Your use creates a security or operational risk.
• You misuse the Platform.
• Required payments are not received.
• Your account is involved in fraudulent or abusive activity.

Where appropriate, BYESKOOL may provide notice before suspension or termination.

Termination or suspension does not remove any obligations that accrued before termination.

21. Disclaimer

BYESKOOL provides the Platform on an “as is” and “as available” basis to the extent permitted by applicable law.

BYESKOOL does not guarantee that:

• The Platform will always be available.
• Every feature will always operate without errors.
• Websites created through the Platform will achieve a particular business result.
• AI-generated content will always be accurate, complete, or suitable for a particular purpose.
• Third-party integrations will always remain available.

You are responsible for reviewing and verifying content generated through AI or other automated features before publishing or relying on it.

22. Limitation of Liability

To the maximum extent permitted by applicable law, BYESKOOL will not be responsible for indirect, incidental, special, consequential, or loss-of-profit damages arising from your use of the Platform.

BYESKOOL's total liability arising from your use of the Platform will, to the extent permitted by law, be limited to the amount you paid to BYESKOOL for the relevant subscription period giving rise to the claim.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.

23. Indemnification

You agree to defend, indemnify, and hold harmless BYESKOOL and its representatives from claims, losses, liabilities, damages, and expenses arising from:

• Your violation of these Terms.
• Your unlawful use of the Platform.
• Your website or customer activities.
• Your content.
• Your violation of another person's rights.
• Your misuse of third-party services.

24. Changes to the Platform

BYESKOOL may add, modify, suspend, or remove features from the Platform from time to time.

We may also update these Terms when necessary.

If material changes are made, BYESKOOL may provide reasonable notice through the Platform, email, or another appropriate method.

Your continued use of BYESKOOL after the updated Terms become effective means that you accept the updated Terms.

25. Governing Law

These Terms shall be governed by and interpreted in accordance with the applicable laws of India .

Any dispute arising in connection with these Terms shall be subject to the jurisdiction of the appropriate courts in India, unless otherwise required by applicable law.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to remain in effect.

27. Entire Agreement

These Terms, together with any applicable policies and agreements referenced in them, constitute the agreement between you and BYESKOOL regarding your use of the Platform.

Additional terms may apply to specific services, including White Label services.
